New York Legal Construction Contracts
|
New Jersey's Home Improvement Practices Act requires that every home improvement
construction contract for more than $500 (and all changes to those contracts) be
in writing and include extensive disclosures: Beginning and completion dates; a
detailed description of the materials to be installed; the warranty. These notices
are designed to inform property owners about potential risks in residential construction
projects. For technical violations, the penalty is $100. For substantial violations,
the penalty is the greater of $250 or 5% of the contract price up to $2,500.

Even if you aren't cited for using a defective contract, legal counsel for your
client will be sure to spot the problem.In addition to the New Jersey disclosures,
federal law requires other disclosures, depending on the type of construction –
residential, commercial or public works. These include truth-in-lending disclosures,
the 3-day right to cancel and insulation disclosures required by 16 Code of Federal
Regulation § 460 ($11,000 fine for omission). The notices and disclosures required
in a legal construction contract for can fill several contract pages. For some types
of work, the shortest legal New Jersey construction contracts will be about eight
pages.
