Construction Contract New Jersey
Nearly every New Jersey construction contract requires specific disclosures and
notices. For example, New Jersey's Home Improvement Practices Act requires that
every home improvement construction contract for more than $500 (and all changes
to those contracts) be in writing and include extensive disclosures, including beginning
and completion dates, a detailed description of the materials to be installed and
the warranty. Failure to comply with the code is a violation of New Jersey's Consumer
Fraud Act. Penalties for violation can include a refund of all money collected or
treble damages plus legal fees.

You need a residential construction contract written to comply with NJ law for remodeling,
home repair, home improvement or casualty loss repair work in New Jersey. A general
construction contract for NJ that lacks the required notices and disclosures is
not a legal construction contract in NJ and can not be enforced.

A new home construction contract does not require the same disclosures. But custom
home builders are required to provide a limited warranty against construction defects
unless disclaimed in the contract.
